These Terms of Service (“Terms”) govern your use of the website and store operated by Madeline LeBlanc under the shop name Making Madi at makingmadi.com (the “Site”), including purchases of physical goods such as bedding, textiles, clothing, and prints. By accessing or using the Site, you agree to these Terms.
About the shop
Making Madi is an online store showcasing and selling products featuring artwork by Madeline LeBlanc. The Site is powered by Shopify. Currency for the storefront is Canadian dollars (CAD) unless otherwise indicated.
Eligibility and accounts
You must be able to form a binding contract in your place of residence to place an order. You are responsible for keeping account credentials confidential and for activity under your account.
Products and orders
- Product images, descriptions, and colours are shown as accurately as reasonably possible; slight variations can occur due to materials, screens, and production methods.
- Many products are made to order. Placing an order constitutes an offer to buy; we may decline or cancel orders for errors, stock/production limits, suspected fraud, or other legitimate reasons.
- Prices, taxes, and shipping are confirmed at checkout. We may correct pricing or availability errors and will notify you if that affects an order already placed.
Intellectual property
All artwork, designs, photographs, text, logos, and other creative materials on the Site are owned by Madeline LeBlanc or used with permission. Purchasing a product gives you ownership of that physical item only—it does not transfer copyright or grant a licence to reproduce, redistribute, or commercially exploit Madeline’s artwork or brand assets. You may not scrape, copy, or reuse Site content for commercial purposes without prior written consent.
Acceptable use
You agree not to misuse the Site, including by attempting unauthorized access, interfering with Site operation, submitting malicious code, or using the Site for unlawful purposes.
Third-party services
The Site may link to third-party sites or services (including payment, shipping, and Madeline’s portfolio at madelineleblanc.ca). We are not responsible for third-party content, policies, or practices.
Shipping, returns, and privacy
Purchases are also subject to our Shipping Policy, Refund Policy, and Privacy Policy.
Disclaimer of warranties
To the fullest extent permitted by applicable law, the Site and products are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits rights that cannot be excluded under Canadian consumer protection law.
Limitation of liability
To the fullest extent permitted by law, Madeline LeBlanc / Making Madi and our suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
Indemnity
You agree to indemnify and hold harmless Madeline LeBlanc / Making Madi from claims arising out of your misuse of the Site, violation of these Terms, or infringement of any rights of another person, to the extent permitted by law.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules. Courts in British Columbia will have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable consumer rights in your province or territory.
Changes
We may update these Terms from time to time by posting a revised version on the Site and updating the “Last updated” date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
